During my thirty years of owning and operating office equipment dealerships in Chicago, Indiana, and Wisconsin, my organizations have helped thousands of small and mid-sized clients acquire the right office equipment for their company’s unique requirements. Brief – A written statement prepared by one side in a lawsuit to explain to the court its view of the facts of a case and the applicable law. There are a number of courts to which judges can be appointed. They are selected based on their experience, ability and good character. Judges are appointed by the Judicial Appointments Commission. To become a judge, you must have had a number of years’ work experience in the courts as a barrister or solicitor. Indigency – Financial inability to hire a lawyer or pay court costs. Defendant – In a civil case, the person being sued. In a criminal case, the person charged with a crime. This means that before the class struggle — and necessarily after it, since in this world there is no before without an after — one or several factors was and will be the motive force of history. It is not difficult to see that this factor in the history of each human group is the mode of production — the level of productive forces and the pattern of ownership — characteristic of that group. Despite being two separate movements, the Women’s Movement and Civil Rights Movement were felt by all African American women. Only this group of individuals can truly say that they fought for two movements simultaneously. Responses: Many quantitative analyses conclude that challenges to the statistical significance of the democratic peace do not withstand close scrutiny. 99 Zeev Maoz has offered one of the most comprehensive rebuttals of these arguments. 100 He argues that Spiro’s own analysis predicts far more wars between liberal dyads that actually occurred. Maoz also argues that it is misleading to count all parties in large, multi-state wars as being at war with one another. (E.g., Japan was not really “at war” with Bulgaria in World War I.) He notes that Spiro changes the counting rule for the Korean War. Maoz and Russett focused on the “politically-relevant” dyads, which account for most wars. Maoz also claims that slicing the data into one-year segments makes finding any war statistically insignificant. Such slicing is like testing whether a bowl of sugar will attract ants by assessing the statistical significance of finding an ant on an individual grain of sugar. The odds that ants will be in the sugar bowl are high; the chances of an ant being on a given grain of sugar, however, are so low that finding one on a grain would not be statistically significant. When Maoz looks at politically-relevant dyads, he finds that one would expect 57.63 liberal dyads at war between 1816 and 1986, but they find only one: the Spanish-American War. 101 He offers similar figures for the 20th century and for militarized disputes. And when Maoz adopts Spiro’s suggestion to look at dyads over their entire history, he finds that conflict actually fell when both countries in a dyad became democratic.
Our government tries to do much more than what it was intended to do. It can’t justify spending money for every cause, just because someone will benefit from it. It is not the government’s job to or re-distribute wealth. Politicians have distorted “promoting the general welfare” to mean empowerment for the federal government to do almost anything as long as it’s intended to help any selected group or individual. Many Americans don’t understand this, and some just look to the government for handouts. Politics seems to be a game, where everyone demands something from the government. We need to stop all of the undeserved entitlements, which are being funded by others. Warrant – Most commonly, a court order authorizing law enforcement officers to make an arrest or conduct a search. An affidavit seeking a warrant must establish probable cause by detailing the facts upon which the request is based. Capitalism, American Style started to fail in the 70s, as the anti monopoly laws were being abandoned, and the monopolies or large corporations started their mergers and acquisitions, and then move their profit centers overseas. So let’s review. The country is heading for insolvency by just about any way you measure reality. Republicans and Democrats, progressive think tanks and conservative think tanks, sometimes working together, have come up with drastic, viable and necessary approaches to avoiding sovereign insolvency. Ordinary Americans have voted do cut unnecessary government expenses via the AP pol, and in the November elections when dozens of Tea Party endorsed candidates were elected to curb spending. Perhaps most notably, democracies believe in freedom. Citizens should have the right to express their opinions and participate in democracy without fear or intimidation. Not only do democratic societies believe that creates a better life for its citizens, it also helps keep governmental power in check. If people can freely—but peacefully—express their opinions, it makes it clear when elected representatives aren’t listening to the will of the people. 9 Vine Deloria, Power and Place: Indian Education in America. (Colorado: American Indian Graduate Center, 2001) p.97. Totalitarianism is an authoritarian form of government in which the ruling party recognizes no limitations whatsoever on its power, either in the public life or private rights of its citizens. Power is often vested in the hands of a single figure, an authority around whom significant propaganda is built as a way of extending and retaining uncontested authority. Totalitarian states often employ widespread surveillance, control over mass media, intimidating demonstrations of paramilitary or police power, and suppression — usually violent — of protest, activism, or political opposition.
In Bosnia and Herzegovina, transition-related economic reforms were initially delayed by the four-year war (1992-95). The Dayton Peace Accords signed in December 1995 brought peace, but not immediate progress with economic reforms. The country was divided into two entities, the Bosnia and Herzegovina Federation and the Republika Srpska, and the autonomous district of BrÄko. The UN appointed High Representative was given wide powers to oversee the implementation of the peace agreement and intervene in political and economic matters. Since most economic policies are decentralised to the two entities, while within the Federation they are further decentralised to the ten cantons, Bosnia and Herzegovina remains in many respects a dysfunctional state. Monetary stability was secured after the end of the war through the introduction of a currency board, but most areas of reform started late and have been slow, including privatisation. In 2000 the contribution of the private sector was only 35% of GDP, though it expanded to around 60% of GDP by the end of the decade. More than twenty years after the end of the military conflict, the country is still facing extraordinary institutional and constitutional problems. Bosnia and Herzegovina is currently only a potential candidate for EU membership. As a paralegal you will need to become familiar with legal terms and especially familiar with terms used in the field of law you end up working in. Should you work for a public defender, prosecutor or criminal defense attorney you will be dealing with more terms relating to criminal law. If you work with corporations you will need to concentrate on corporate law, contractual terms and the Uniform Commercial Code (UCC). This same principle holds true for working with tax attorneys, family law or estate law. Understanding legal terminology is vital for understanding the law itself and properly applying it in research, legal analysis, document preparation and compliance with local, state and federal judicial systems. First and last Commonwealth treason trial. Major Charles Cousens was committed for trial in the Sydney Magistrates Court in August 1946. The charge was dropped due to lack of evidence. In the fall term of her second year, Hansberry became campus chairman of the Young Progressives of America in support of Henry Wallace’s 1948 candidacy. Upon his defeat, she grew disaffected with party politics but continued to enjoy her friendships with African students and a number of young campus radicals. Her network of friends in Wisconsin would later become the material for a section of her unfinished autobiographical novel All the Dark and Beautiful Warriors. Particularly during the 1970s, the ill-conceived social compacts concluded at the level of the republics were in no way able to substitute for an efficient system of macroeconomic governance. The Yugoslav model failed to invent alternative governance mechanisms that would have ensured major coordination of economic policies at the federal level, but in line with the different economic interests of its republics and regions. Inquisitorial. Judges, not lawyers, ask questions and demand evidence. Lawyers present arguments based on the evidence the court finds. As I mentioned months ago in one of your other Hubs, I would be all for creating a standard where people at least get paid enough to afford their basic living needs for themselves and their families – rent, food, utilities, education, healthcare – and then eliminate the need for the government to over tax and provide these services, at times at a terrible degree. I would even go so far as to say instead of providing certain services for free, that many people take for granted, like education, people could instead take out a loan for the government which gets paid back over an extended period of time. I think our government, as much as it helps the middle, lower, and working classes, also steals from them. It’s difficult to justify taxing to provide services to the poor when those taxes can add up to 35-40% for families earning a low income (I’m including income, sales, and all other taxes in this figure). I am for personal freedom and personal choice, including the choice to do the wrong thing. I agree that if socialism goes too far, it in effect, takes away many of our freedoms. Statute law (legislation) is law made by state and Commonwealth parliaments. Proposed new laws are introduced into parliament as bills, and go through certain steps before they become law. They are then known as statutes, or Acts of Parliament. The Victorian parliament makes law in certain areas for the people of Victoria. The federal parliament has powers in other areas to make laws for all Australians.
